PlazaDRM Terms and Conditions of Service
By using the services provided by Paradimage Soluciones SL (hereinafter, “Paradimage”) under the PlazaDRM brand (hereinafter, “Plaza”), or the “Lector Plaza” application (hereinafter, the “Reader”), you agree to these Terms and Conditions (hereinafter, the “Terms”). If you do not agree to them, do not use the online services at plazadrm.com, and do not install the Reader or the WordPress plugins. If you have any questions, you can contact us via the contact form.
About Us
Paradimage is an online publisher that publishes classic and contemporary works and sells them through its website, https://paradimage.es. The publisher also maintains pages and accounts on major online bookstores and social media platforms. For some titles, print versions are also sold, either directly or through third parties.
In addition to its publishing activities, Paradimage offers complementary services within the audiovisual sector, including the PlazaDRM content distribution service, provided through this website.
What Is PlazaDRM
PlazaDRM is the generic name for a set of services provided by Paradimage aimed at distributing copy-protected audiovisual material. The ecosystem consists of several elements:
- The Reader: a free mobile app that allows customers to read e-books and play videos purchased from various online stores (the “partner stores”). The audiovisual content in the Reader is encrypted to prevent illegal copying.
- Partner Stores: WooCommerce-based online stores that sell audiovisual content and choose to distribute it through El Lector, which provides copy protection. To distribute their content through El Lector, the store must register for the service and configure the Plaza plugin on its website. The cost of the service consists of a commission per book sold, according to the financial terms agreed upon in each case.
Age Ratings and Content Unsuitable for Minors
The Plaza Reader is rated as an app suitable for all audiences (“for all ages”) in app stores (Google Play, App Store, etc.), insofar as the app itself does not generate or filter content: it merely displays the material that each partner store makes available to its customers.
Consequently, when a partner store distributes, through Plaza, content that is not suitable for all audiences (due to its subject matter, violence, explicit sexual content, or other reasons), it is the sole responsibility of that partner store to:
- properly label content in accordance with the applicable regulations in your market;
- establish age verification mechanisms or other access control measures as necessary prior to sale; and
- be accountable to your customers, authorities, and third parties for any noncompliance in this regard.
Paradimage does not review or validate content uploaded by partner stores and assumes no liability whatsoever for minors’ access to inappropriate content distributed by a partner store. Audiovisual material is downloaded directly to the Player from the partner store; therefore, Plaza has no knowledge of—nor can it have knowledge of—the nature of such content, nor does it assume any liability for it.
Prohibited Content
Notwithstanding the foregoing, partner stores are expressly prohibited from distributing, through PlazaDRM’s services, any content that:
- constitutes or promotes criminal or terrorist activities, or advocates for them;
- includes child pornography or any form of exploitation or abuse of minors;
- incites hatred, discrimination, or violence based on origin, race, sex, religion, sexual orientation, disability, or any other condition;
- infringes on the intellectual or industrial property rights of third parties; or
- is, in general, illegal under Spanish law or the law of the country where the content is intended for distribution.
The detection of any of these circumstances will entitle Paradimage to immediately suspend, without prior notice, the distribution of the affected content and, where applicable, the account of the affiliated store involved, without prejudice to any legal actions that may be warranted.
Intellectual Property
Partner stores and creators who choose to sell through the Reader using their own brand grant Paradimage limited-term, non-exclusive distribution rights in order to enable the provision of the service.
Downloading audiovisual material through PlazaDRM does not grant you the right to publish it, where “publication” is understood to mean any means of making the downloaded work available to the public, even on a restricted basis. In the event that the download consists of encrypted material (as is the case with e-books and videos downloaded by the Reader), it is expressly prohibited to decrypt it.
PlazaDRM also has its own material, which you may not use without our consent. This material includes, but is not limited to: our logo and brand, the Reader, the WordPress plugin, the content of the websites under the PlazaDRM domain, etc. Registering and using our services does not grant you any ownership rights to the aforementioned material.
Privacy Policy and Personal Data Processing
PlazaDRM’s privacy policy is an integral part of these Terms and Conditions of Service and can be found at https://plazadrm.com/privacy-policy/, along with the date it will take effect, and it supersedes any previous version.
Cancellation of service
Partner stores may cancel the service at any time by deleting their account on our website and uninstalling the WordPress plugin from their website. Once the service is canceled:
- customers who have already downloaded and activated the purchased content in the Reader will retain access to that already downloaded content;
- however, they will not be able to download it again (for example, after changing devices, reinstalling the Reader, or losing the local file), since the partner store will no longer be operational within PlazaDRM;
- it will be the sole responsibility of the partner store to handle any customer complaints arising from the loss of access to future re-downloads following cancellation of the service, and Paradimage assumes no liability in this regard.
While the distribution service is active, Paradimage does not have access to the content you sell, which is distributed directly from your store to the end customer’s device.
Limitation of liability
While it is our intention to maintain the services described indefinitely, we reserve the right to modify them, discontinue them, or add new services. We assume no liability for any damages that these decisions may cause.
We will endeavor to keep our services available 24 hours a day, but we cannot guarantee this under any circumstances, nor can we guarantee the integrity of the data in all circumstances. In terms of functionality, the Reader, the WordPress plugin, and the services hosted on the websites of the plazadrm.com domain are provided “as is,” and therefore may not necessarily meet the needs of all users. Nor do we accept any liability for damage to the customer’s equipment, such as the loss of information on the user’s computer.
We assume no liability whatsoever for the content of material distributed through Plaza Paradimage’s services, to which we generally have no access, beyond what is required by the laws of the Kingdom of Spain.
Notwithstanding the foregoing, and for the purpose of clarifying the allocation of risks between the parties:
- The service is provided “as is,” without any guarantee of uninterrupted availability or the total absence of errors.
- Paradimage does not access, review, or assume responsibility for the content sold by partner stores (artworks, third-party rights, prices, customer service, etc.); such responsibility rests exclusively with each partner store.
- Under no circumstances shall Paradimage be liable to a partner store, its customers, or third parties for indirect, incidental, or consequential damages, including, without limitation, loss of profits, loss of sales, loss of data or content, business interruption, or reputational damage, even if warned of the possibility of such damages.
- Paradimage’s total and aggregate liability to a partner store for any cause related to the provision of these services shall be limited, in all cases, to the amount actually paid by said store to Paradimage during the 12 (twelve) months preceding the event giving rise to the claim.
- This limitation shall not apply in cases of willful misconduct or gross negligence on the part of Paradimage, duly proven in accordance with applicable law.
At PlazaDRM, payments are processed through Stripe (or other payment gateways that may be enabled). Paradimage is not responsible for the operation of the payment gateway; however, if any amount is mistakenly paid for a service not rendered, we will, of course, issue a refund.
Applicable Jurisdiction
Any dispute regarding the content of this contract will be resolved by the parties in good faith; if this is not possible, the matter will be submitted to the courts of Madrid.
Amendments to These Terms
These Terms are effective as of the date indicated at the beginning of this document and may be amended by Paradimage at any time to adapt them to regulatory, technical, or service-related changes. The updated version will always be published at https://plazadrm.com/terms-and-conditions/, with an indication of the date on which it will take effect, and will supersede any previous version, including any version attached as an appendix to any prior proposal or commercial contract.
